Discipline & Discharge - Avoiding Wrongful Termination
One of the most awkward supervisory issues is that of the disciplinary process. Because it may involve confrontation and conflict, supervisors are often tempted to avoid these discussions. In no other activity is it more important to “do it right” every time. Today’s fast changing legal environment makes it difficult to know how and when to discharge and how to avoid violating the law. Failure to have solid employee discipline and documentation practices can cause any Human Resource department a tremendous amount of stress. This session will reinforce the critical steps of appropriate discipline and documentation activities.
- The difference between coaching and discipline;
- What “performance reminders” are and how they can be used;
- How to discipline and document the disciplinary action;
- The benefits of progressive discipline;
- Use of separation agreements, reduction in force policies, and exit interviews;
- Negligent hiring and retention;
How to reduce the risk of lawsuits and avoid wrongful termination.
This practical session will provide useful suggestions that make this difficult process easier. Discussion and exercises will be drawn from actual workplace situations. This session will be accompanied by an extensive handout packet.
